Fundraising Terms and Conditions
- Introduction
These Fundraising Terms and Conditions outline the responsibilities, expectations, and obligations of individuals or groups (“Fundraisers”) who choose to raise funds in support of the Legacy Club of South Australia and Broken Hill (“the Club”). By organising or participating in a fundraising activity on behalf of the Club, you agree to comply with these Terms and Conditions.
- Authority to Fundraise
- Fundraisers must obtain written approval from the Club before commencing any fundraising activity.
- Approval is granted for a specific activity and does not imply endorsement of future events.
- The Club reserves the right to decline any fundraising proposal that may conflict with its mission, values, or legal obligations.
- Legal and Financial Responsibility
- Fundraisers are responsible for ensuring their activity complies with all relevant local, state, and federal laws, including permits, insurance, and safety requirements.
- All fundraising activities are conducted at the Fundraiser’s own risk. The Club accepts no liability for any loss, damage, or injury resulting from the activity.
- Fundraisers must keep accurate financial records and ensure that all funds raised are transferred to the Club within seven (7) days of the event’s conclusion.
- Use of the Club’s Name and Branding
- Fundraisers may only use the Clubs’s name, logo, or branding with prior written consent.
- Any promotional materials must clearly state that the activity is “in support of” the Club and not run by the Club.
- The Club reserves the right to request changes or withdraw permission for branding use at any time.
- Handling of Donations
- All donations collected must be handled responsibly and securely.
- Fundraisers must not retain any portion of the funds raised as personal profit or compensation.
- Tax-deductible receipts can only be issued by the Club and only for eligible donations in accordance with Australian tax law.
- Corporate Sponsorships and Partnerships
- Fundraisers must seek approval before approaching businesses or corporate partners for sponsorship or in‑kind support.
- The Club may decline association with companies or brands that conflict with its values or regulatory obligations.
- Marketing and Promotion
- Fundraisers are responsible for promoting their own activities.
- Promotional content must be respectful, accurate, and not misleading.
- The Club may choose to share or promote the activity at its discretion but is under no obligation to do so.
- Privacy and Data Protection
- Fundraisers must comply with applicable privacy laws when collecting personal information from participants or donors.
- Personal information collected during the activity must not be shared, sold, or used for purposes unrelated to the fundraising event.
- Cancellation or Changes
- The Club reserves the right to withdraw approval for a fundraising activity if circumstances arise that may negatively impact the Club’s reputation or operations.
- Fundraisers must notify the Club promptly if the activity is cancelled or significantly altered.
- Transfer of Funds
- Funds raised must be transferred to the Club via approved methods such as bank transfer, online donation portal, or cheque.
- A summary of funds raised, including any expenses deducted (if pre‑approved), must be provided.
- Acknowledgement
By conducting a fundraising activity for the Legacy Club of South Australia and Broken Hill, you acknowledge that:
- You are acting independently and not as an employee, agent, or representative of the Club.
- You accept full responsibility for the planning, execution, and safety of the activity.
- You agree to comply with these Terms and Conditions at all times.
